Robo Calls and Ringless Voicemails
Robocalls are automated prerecorded voice messages which are often sent in bulk as a marketing tactic by companies to increase their profits without the cost of hiring live agents or employees to make live phone calls on their behalf. These voice messages may include the voice of a prerecorded person, an artificial intelligence created voice or artificial computerized voice. Many times, depending on your phone or mobile software, these messages may be delivered directly to your cell phone voicemail box without your phone even ringing as a Ringless Voicemail.
These messages, may have been sent to you in violation of the Telephone Consumer Protection Act of 1991. Pub. L. No. 102-243, 105 Stat. 2394 (1991) (codified at 47 U.S.C. § 227) (the “TCPA”). As Congress explained, the law was a response to Americans ‘outraged over the proliferation of intrusive, nuisance calls to their homes from telemarketers’ id. § 2(6), and sought to strike a balance between ‘[i]ndividuals’ privacy rights, public safety interests, and commercial freedoms’ id. § 2(9).
There are various other state laws which may also protect you from the intrusiveness and annoyance of these Robo Calls and Ringless Voice Mails. For instance, the Florida Telephone Solicitation Act (“FTSA”), Fla. Stat. § 501.059, similarly protects Florida residents from these types of messages.
